1.Disclosures of Personal Information

DARCARS does not sell, rent, or share personally identifiable information to or with any third party not affiliated with or owned by DARCARS, except service providers who may assist us in such areas as our promotions, credit checks, data storage and order processing (See Agents and Vendors below). DARCARS will never give or sell your personally identifiable information to unaffiliated third parties to be used for the purposes of sending you unsolicited commercial offers, such as spam. We may, however, use your personal information to send you commercial offers in e-mails from DARCARS or its affiliated companies, which do not relate to the products or services you have ordered. You may altogether avoid or opt out of these marketing campaigns (see "Opting Out" below).

A. Our Agents and Vendors pursuant to Business Purpose

DARCARS may use other companies and/or individuals to perform any functions described in this Privacy Policy, on our behalf. Examples include marketing, credit checking, data and network hosting, service reminders, verification of sales, order processing and fulfillment, administering contact information and e-mail services and running special promotions. Such parties only have access to the personal information needed to perform these functions and may not use or store the information for any other purpose. We obtain commitments from these agents and vendors working on our behalf to refrain from using any information provided by DARCARS to send you unsolicited e-mail messages from third parties or similar communications and from sharing your information with unrelated parties.

2.Accessing and Correcting Your Information

You can review and change your personal information by logging into the Website and visiting your account profile page.

You may also send us an email at compliance@darcars.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

3.Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions and financing applications will be encrypted.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our websites. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the websites.

4.Opting Out

5.Lexus Corporate Privacy Disclosures (Applicable only to DARCARS Lexus dealerships)

DARCARS Lexus dealership forms will be used and tracked by Lexus Corporate. Personally identifiable information will be shared with Lexus Corporate and may be used by Lexus for their own marketing purposes.

DARCARS Lexus and Lexus, a division of Toyota Motor Sales, USA Inc, are non-affiliated third parties. DARCARS Lexus privacy statement applies only to the Dealership websites and not Lexus Corporate Website.
